Excellence AG collects and processes personal data of visitors to the website received or gained from the user in the course of the user process. Every time you contact us by email, the information submitted by you (email address, name, if required, and your telephone number) will be stored with us to allow us to respond to your request. The data generated in this context will be deleted, if retention of this information is no longer needed. Otherwise, processing will be restricted, if there is a legal obligation to retain the data.

Excellence AG processes personal information in accordance with applicable data protection regulations, in particular, the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG), in order to comply with contractual obligations (Article 6 paragraph 1 sentence 1 (b) of the GDPR), within the scope of taking into account all interests (Article 6 paragraph 1 sentence 1 (f) of the GDPR), based on the consent of the user of this website (Article 6 paragraph 1 sentence 1 (a) of the GDPR), or based on statutory or legal provisions (Article 6 paragraph 1 sentence 1 (c) of the GDPR).

Excellence AG processes and stores the personal data only as long as stipulated by respective applicable statutory provisions and potential mandatory retention periods.

The personal data described here will be disclosed exclusively, if these are required to provide the relevant service, or prescribed by law within this legally defined framework (see Article 6 paragraph 1 (a) and (c) of the GDPR). Within the scope of the purposes mentioned here, personal data are disclosed to service providers who work on our behalf and, in particular, support us to render the service. In addition to their statutory obligations to the compliance of all data protection regulations, these service providers are also subject to further contractual privacy provisions by us. In general, this includes an obligation as order processor according to Article 28 paragraph 3 of the GDPR.

Apart from that, we will disclose personal data to third parties exclusively, if there is a legal permission for us to do so, or upon your prior consent. You are entitled to revoke your already given consent at any time with effect for the future. We disclose personal data to government authorities exclusively within the framework of legal obligations, or as a result of an official order or court decision, if this is pursuant to data protection legislation.

The data will be deleted, as soon as the data are no longer needed for the purposes for which they were initially processed, or if an effectively given consent has been revoked and no other retention obligations exist for Excellence AG.

 A longer retention period may result from legitimate interests of Excellence AG, for example, the provision of evidence to enforce or defend legal claims, but also on the basis of the initiation or processing of an existing agreement relationship, or your prior consent.

If required for our purposes, we may also disclose your personal data to recipients outside the EU. This will apply, in particular, if we have to disclose these data to recipients in other countries as part of order processing, or due to statutory provisions.

Apart from that, we will disclose information to third party countries exclusively, if it is ensured that the recipient of the data assures an appropriate level of privacy within the meaning of chapter V of the GDPR, and that there are no other interests worthy of protection against the data transfer. In particular, we use sample agreements of the EU commission regarding the transmission of personal data to third party countries in order to ensure an appropriate level of privacy on the part of the recipient of the information.

Your personal data is not used for automated individual decision making within the meaning of Article 22 paragraph 1 of the GDPR.

 

§ 2 Your legal rights

With respect to your personal data, you will be entitled to the following rights towards Excellence AG, insofar as the statutory prerequisites exist:

Right to submit a complaint to a data protection regulatory authority in charge according to Article 77 of the GDPR in context with Article 19 of the Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG).

Provided that your personal data are processed based on legitimate interests in accordance with Article 6 paragraph 1 lit. (f) of the GDPR, you will be entitled, according to Article 21 of the DSGVO, to object to the processing of your personal data on grounds relating to your particular situation, or if the objection is directed against direct marketing purposes. In the latter case, you have a general right to object which will be implemented by us without the requirement of a reference to a particular situation. If you would like to make use of your right to object, a notification by email to datenschutz@excellence.ag is sufficient.

 

§ 3 Collection of personal data during your visit on our website
